
To avoid prosecution by the Nassau County District Attorney for the trampling death of a temporary worker, Wal-Mart Stores Inc. has agreed to upgrade post-Thanksgiving Day crowd-control measures in 92 of its New York stores.
As part of the agreement, Wal-Mart will have its plan approved by independent safety consultants and provide $400,000 in expedited restitution to victims of the confrontation. Wal-Mart will also donate $1.5 million to Nassau County social-service programs and will hire 50 local high school students every year for the next three years.
Hank Mullany, president of Wal-Mart’s northeast division, said that the company has never had a tragedy like the trampling death in their stores and that they do not want it to happen again.
Last November, Jdimytai Damour, a 34-year-old temporary maintenance worker at a Valley Stream, New York Wal-Mart, was killed after he was knocked down and trampled by several hundred shoppers on the day after Thanksgiving, which is a busy shopping day known as “Black Friday.” The shoppers had burst through Wal-Mart’s doors, as they raced to purchase discounted merchandise. According to the DA, there were 11 people who claimed that they were injured in the accident.
Individuals who have documented expenses and injuries may be able to recover compensation from a $400,000 fund. To obtain compensation, these individuals will have to waive their right to a separate civil lawsuit against Wal-Mart.
