Shirley Man Rented Car to Avoid Using Breathalyzer

According to police, a Shirley man rented a car to avoid the court-mandated breath analyzer system in his own vehicle.  He ended up crashing into a Brentwood telephone pole and was charged with drunk driving on the morning of Sunday, February 15, 2009. 

Marvin Rice Jr., a 27-year-old man, was heading north in his vehicle on Wicks Road in Brentwood at approximately 5:52 AM when he lost control of the rented car and smashed into a pole at Crooked Hill Road, said Suffolk police.

Based on court records, Rice was convicted in 2005 of driving under the influence of alcohol or drugs (DUI) and agreed to participate in the ignition interlock device program, police said.

The ignition interlock device program requires drivers to submit to a breath test before the vehicle can be started.  It measures the blood alcohol content of the driver.  If alcohol is detected, the engine will not start.

Rice rented a 2007 Volkswagen Jetta from Enterpise Rent-A-Car that was not equipped with the ignition interlock devise, said Suffolk police Sgt. Kevin Beyrer. 

Rice was taken by Suffolk police helicopter to Stony Brook University Medical Center, where he was admitted with multiple injuries, according to police.  No one else was injured in the accident.

It is believed that he rented the car so that he could drive drunk.

He was charged with driving while intoxicated.  Rice has prior convictions, which include endangering the welfare of a child in 2007 and driving without a license in 2005.

Rice has an arraignment scheduled for April 13 at First District Court in Central Islip.
