
The widow of a construction worker from Mannsville has filed a lawsuit against Hanson Aggregates New York Inc. and Hanson Aggregates North America Inc., Lehigh Cement Co., and Villager Construction Inc. over the death of her husband.
James C. Eastman was run over and killed by a bulldozer while working at Hanson Aggregates property on May 12, 2008. The 64-year-old was fatally injured in the New York bulldozer accident when he lost control of the bulldozer he was using to build a ramp on the property. He was partially ejected from the bulldozer and run over by its left track.
Mr. Eastman’s widow, Loretta K. Eastman, is the executor of the estate and filed a state Supreme Court action at the Jefferson County clerk’s office. She claims that the ramp was unstable, which caused it to partially collapse. As a result, Mr. Eastman lost control of the bulldozer and was thrown off.
According to Ms. Eastman, Hanson Aggregates was negligent for allowing a “defective and dangerous” condition to exist on the property. She also alleges that all of the named defendants were negligent for lacking supervision and inspection of the condition.
Villager Construction had been contracted to build the ramp, which went from a 75-foot elevation down to a landing area, according to court documents.
The lawsuit does not list a specific amount of damages that are being pursued.
