Lawsuit Filed in New York Over Faulty Elevators

According to a federal class-action lawsuit that is expected to be filed, New York City’s public housing agency is violating the rights of tenants with disabilities and other health problems by failing to properly maintain its elevators, which has left them stranded for hours during frequent breakdowns.

The plaintiff, which includes seven tenants, has accused the city agency of a “widespread and systemic failure to maintain the elevators in its buildings in operable working condition” in violation of human rights and disability laws.

Wilma Brito, a 38-year-old woman, is one of the seven tenants involved in the lawsuit.  She lives on the 10th floor of a building in the George Washington Carver Houses in East Harlem and has cerebral palsy and uses a wheelchair.  According to Brito, last month both elevators in her building were not working for three days.  Three years ago, she became stuck outside her building at night after both elevators stalled.  By the time the elevators were repaired, her wheelchair batteries had died.

The New York City Housing Authority maintains the elevators, which have been under scrutiny since a 5-year-old boy died in August.  The boy, Jacob Neuman, fell 10 stories down a shaft after trying to escape from a stalled elevator at a Brooklyn complex.  According to elevator experts, there were electrical problems that were linked to faulty maintenance.

The Housing Authority provides low-rent apartments subsidized by the federal government to poor and moderate-income families.  The agency is in charge of maintaining 3,338 elevators in 2,618 buildings.
