Q: Are New York nursing homes regulated?

A:

There are state and federal laws that regulate nursing homes.  If you have a parent or grandparent living in a nursing home, you should be aware of these laws.

A federal law, known as the Nursing Home Reform Act, was enacted in 1987 and provides protection for nursing home residents living in facilities that receive funds under Medicaid or Medicare programs.  This law also regulates various aspects of care, staffing, privacy, restraints, quality of treatment and record keeping.

Under the Nursing Home Reform Act, there are certain guidelines that nursing homes must follow and penalties are imposed for violations.  Nursing homes must provide residents and their families with a list of rights under the law.

In New York, nursing home residents also have protection from abuse through the New York State Protective Services for Adults Program.  This agency provides aid and protection for victims of elder abuse.  The New York State Office of Long Term Care Ombudsman is another advocate for nursing home residents, as this office focuses on protecting the rights of individuals living in New York nursing homes.
